Nirbhaya died on December 29, 2012 in a hospital in Singapore. This incident shook the conscience of the entire country. This incident was discussed not only in the country but also abroad and later the law in rape cases was changed and the punishment was forced to be toughened.

Nirbhaya incident, what happened that night?

It was night when a 23-year-old physical therapy student left a movie theater and was walking home with her friend. They both boarded a bus at the Munirka stop in Delhi. There were no passengers on that bus, only some staff members. Six people present in the bus first sexually abused Nirbhaya and then beat her companion with iron rods. After that, six people took turns raping the girl crossing the limits of brutality and inserted an iron rod into her private parts. Both the girl and her friend were thrown naked by those people on the side of the road and fled from the bus.

The girl was admitted to the hospital, continued fighting the battle of life and death and in agony committed suicide. After her death she was named Nirbhaya. This incident shocked the entire country and there were massive protests across the country and demands were raised for the safety of women. Only after this scandal did the government have to change the law and provide strict punishment for rape. One of the Nirbhaya culprits committed suicide, four criminals were hanged in March 2020, while one was a minor, who was released after serving three years in prison.

How much has the situation changed after 12 years?

Today has been 12 years since the Nirbhaya incident. The law changed and the punishment in rape cases became stricter, so that crimes against women could be reduced. The juvenile law was amended after this incident because one of the six Nirbhaya convicts was a minor and was released after three years. The death penalty was also provided for in cases of rape. But statistics show that before 2012, an average of 25,000 rape cases were recorded each year, but later this figure exceeded 30,000. In 2013 alone, more than 33 thousand cases were registered and in 2016 the figure reached nearly 39 thousand.

The statistics are scary, how many are punished?

Statistics from central government agency National Crime Records Bureau (NCRB) show that more than four lakh crimes against women are registered in India every year. As Delhi crossed the boundaries of cruelty with Nirbhaya, crimes against women increased by 116 per cent and rape cases doubled.

Talking about punishment in these cases, according to the Union Home Ministry, the punishment rate in cases of crimes against women increased by 29.8% in the year 2020. According to the ministry, the conviction rate in 2016 was 18.9%. In 2020, investigations were launched in some 43,000 rape cases throughout the country, while only in 3,814 of them the accused could be convicted.

According to NCRB data 2021, a total of 3 lakh 71 thousand 503 cases of crimes against women were registered in 2020, in which a total of 3 lakh 98 thousand 620 people were arrested. 4 lakh 88 thousand people were charged and only 31 thousand 402 people were punished.

Two months ago, new criminal laws, known as the Indian Justice Code, BNS, were enacted, which defines rape in Article 63 and provides for punishment in Articles 64 to 70.

There is a provision of strict punishment in case of statutory rape in BNS, in which if found guilty of raping a girl below 16 years of age, the punishment will be a minimum of 20 years, this punishment can extend up to the chain life. prison. If sentenced to life imprisonment, the convicted person will spend his entire life in prison.

If convicted in gang rape cases, a penalty ranging from 20 years to life imprisonment and a fine is provided. According to article 70 (2) of the BNS, anyone found guilty of gang rape of a minor will be punished with at least life imprisonment, but may also receive the death penalty.

According to article 66 of the BNS, if the woman dies or falls into a coma-like state in the case of rape, the guilty party will be sentenced to a minimum sentence of 20 years in prison. This penalty can be increased to life imprisonment or even the death penalty.

A new section 69 has been added to the Indian Judicial Code. In this, if someone has sexual relations with a woman through a false promise of marriage, employment or promotion, they can be punished with a prison sentence of up to 10 years. In addition to this, a fine will also be imposed. This provides for a 10-year prison sentence for marrying while hiding one’s identity.
